When parties desire more legal advice than provided in an uncontested divorce, but wish to avoid the expense and acrimony of the litigation involved in a contested divorce; a mediated divorce is the answer.
What are the benefits/detriments of a mediated divorce?
You do not have to meet the standard of proof required in a trial. e.g. both parties know that one party paid the down payment on the house but that party would have to show by bank and escrow records and perhaps with a forensic accountants expert testimony if the matter went to trial. On the other hand now that both parties know this – will they want to be fair or legal?
Technically the divorce I offer is not mediation. It is an uncontested divorce – where I require my client to direct me to explain the realities of the situation to both sides (or I will not take the case as being uncontested or mediated) and both sides can decide whether or not to agree to a judgment. I am however the lawyer for only one side. (I require this so I can submit paperwork to the court as one side or the other’s attorney)
If there is no negotiation or any other action required this is done for a flat fee as explained in my Uncontested Divorce page. If however, negotiation is required, I bill at my hourly rate, currently $350/hour
